What is naturalization? How Di Martino Law Group can help you in the process of Naturalization?

Naturalization is the process of becoming a United States citizen. This can be done in a few ways: being born in the United States, being born to American parents abroad, or taking the oath of citizenship. After meeting the requirements, you must file Form N-400, Application for Naturalization. You will also have to attend an interview with a USCIS officer and pass the naturalization test. With the help of immigration law services in the US, the process will be much easier.

What are the requirements for naturalization?

In order to be eligible for naturalization, you must meet the following requirements:

-You must be at least 18 years old.

-You must have been a lawful permanent resident for at least five years.

-You must have been physically present in the United States for at least 30 months out of the last five years.

-You must have resided in the United States for at least three months prior to filing your application.

-You must be able to read, write, and speak English.

-You must have a basic knowledge of U.S. history and government.

-You must be of good moral character.

-You must demonstrate an attachment to the principles of the Constitution.

-You must be willing to take the oath of allegiance.

What is the naturalization test?

The naturalization test consists of a questionnaire about U.S. history and government. You must answer six questions correctly in order to pass. The questions are available in English, Spanish, Chinese, Vietnamese, and Korean.

What is the continuous residence requirement for naturalization?

The continuous residence requirement for naturalization is that you must have been physically present in the United States for at least 30 months out of the last five years. This means that you cannot have spent more than 180 days outside of the United States during that time period. If you have, you may still be eligible for naturalization, but you will need to provide an explanation.

You can prove your physical presence by providing copies of your immigration documents, such as your passport, visa, and I-94. You may also take help from an Italian lawyer for US immigration.

What is the naturalization process?

The naturalization process begins by filing Form N-400, Application for Naturalization. You will also need to submit a copy of your biometric data, such as your fingerprints and photograph. You will then have to attend an interview with a USCIS officer. If you pass the interview, you will be scheduled for the naturalization test. Once you pass the test, you will be sworn in as a U.S. citizen.

The simple requirement is that you must live in the United States for five years before applying for naturalized citizenship. That doesn’t imply that they must live in a house or rent an apartment; you may stay with family or friends.

If you don’t have a lease or deed, you’ll need to show proof of residency. You will still be required to obtain a bank statement and other papers showing the person’s address if one exists.  It’s also important to note that applicants must meet the state’s residency requirements for at least three months before applying.  Please note that there are exemptions in the law for members of the military and their families.

Dealing with faulty immigration judgments

When someone does not fulfill the continuous residency rule, but immigration authorities think they did, an unpleasant situation may arise.  Immigration and naturalization law provides options to those.  Who are falsely accuse of not being in the country for the full period.  Many immigration rulings take into account appeals and reconsiderations, and an initially negative action may reverse. A showing of residency that overcomes a first unfavorable decision might help to correct the problem. It’s possible that you must appear in an immigration court for a hearing to resolve the issue. If the judge finds your evidence adequate, he or she may rule to correct any illegal actions by immigration authorities.
