Resolve Green Card Abandonment Worries With Immigration Lawyers

The abandonment of a permanent resident card, also known as a “green card,” is a serious matter. If you are a permanent resident who has abandoned your status, you may be barred from returning to the United States. In some cases, you may even be deported and you need to consult with an Italian immigration attorney.

Leaving the United States:

The most common is by leaving the United States for an extended period of time. If you leave the U.S. for more than one year, or if you leave for less than one year but it is clear that you do not intend to return, you will be considered to have abandoned your residency.

Failing to file income tax:

Other ways of abandoning your residency include failing to file income taxes as a permanent resident for any year or declaring yourself a “non-resident” of the United States on your tax return.

You will need to apply for a new immigrant visa at a U.S. consulate or embassy. If you are eligible, you will be able to return to the United States as a permanent resident.
